Judgment

1. Heard on admission.

2. The submission of learned counsel for the appellants praying

for mercy approach on the ground that rightly or wrongly,

[2025:RJ-JD:20775-DB] (2 of 2) [SAW-506/2025]

admission was granted and, therefore, the same ought to be

protected, does not impress us. The appellants as well as the

institution, which granted admission, were in full notice and

knowledge that the appellants had failed to clear NEET-PG

examination and, therefore, no admission could be granted. The

illegality committed with open eyes cannot be allowed to be

perpetuated and made an example for committing such mistakes

in future.

3. The appeal is, therefore, dismissed.

4. We further find that the respondent no. 3 had granted

admission, therefore, respondents no. 1 and 2 are directed to hold

appropriate enquiry and initiate action against the respondent no.

3, if found guilty.
