Learned counsel for the appellant seeks permission to

withdraw the present appeal with liberty to the accused appellant,

Jasrath @ Dholu, to pursue another appeal bearing D.B. Criminal

Appeal No. 519/1998 filed by him along with other co-accused, as

in both appeals the challenge to the impugned judgment and

conviction dated 06.09.1998 is the same, and the accused

appellant is named at No.4 in D.B. Criminal Appeal No.519/1998.

Upon this submission, duly verified from the record, the

present criminal appeal is dismissed as withdrawn with liberty to

the appellant, Jasrath @ Dholu, to continue to pursue his case in

D.B. Criminal Appeal No. 519/1998: Ram Kumar & Ors. Vs. State

of Rajasthan.
