3. WHETHER in view of the appointment being given, it can be taken that the authority had given appointment keeping in view the fact that the candidate became over-age on account of non-determination of the vacancies year by year?

4. Composition and strength of the Service.-

(1) The nature of posts included in the Service shall be as specified in column 2 of the[Schedule-I]. (2) The strength of posts in each grade shall be such, as may be determined by Government, from time to time, provided that Government may-

(a) create any post permanent or temporary, from time to time, as may be found necessary:

and

(b) leave unfilled or hold in abeyance or abolish any post, permanent or temporary, from time to time, without thereby entitling any person to any compensation.

5. Constitution of the Service.-

The Service shall consist of :-

(a) persons holding substantively the posts specified in the [Schedule-I];

(b) persons recruited to the Service before the commencement of these Rules; and

(c) persons recruited to the Service in accordance with the provisions of these Rules.

Schedule - I [3.] (1) Peon (2) Cycle-Peon (3) Orderly (4) Waterman (5) Chowkidar (6) Farrash (7) Equivalent posts sanctioned for office work in lowest scale. [(8) Laboratory servant][ S. No. 8 added vide Notification No. F.4(1) DOP/A-II/78, dated 16-8-85]

Explanation.- (i) Equivalent posts sanctioned for office work in the lowest scale will include posts sanctioned in the scale of pay identical to the scale of pay sanctioned for the post of Peon and will not include posts sanctioned for field job, or factories or workshop or for which a separate line of promotion is provided e.g. Helpers, Mates, Insect-collectors, Lab. Boy etc.

Factual Position I- Factual Position and views of (i) Director, Ayurved has stated that no post of committee:- Ward Boy, Ward Mate, Sweepers have been created in the Hospitals of Ayurved Department. In Ayurved Colleges there are posts of Ward Boys whose recruitment qualification is only literacy. Recruitment is made through Employment Exchange. There is no Provision of training after appointment.

Inclusion of post of Ayurved Paricharak in the Service Rules is under consideration at the level of State Government.

(ii) The pay scale of the post has been taken from Section 'C' of the RCS (Revised Pay) Rules 2008 i.e., Common posts in various departments in existing pay scale Rs. 2550- 3200(1). Now in running pay band-1S (4770- 7440) Grade Pay Rs. 1300.

(iii) Post of Paricharak is not included in the Services Rules. Therefore, Neither Recruitment

II- Views of the committee

(iv) The prime demand of the Rajasthan Ayurved Paricharak Sangh is to include them in Subordinate Service and to grant them pay scale equivalent to Cattle Attendant of Animal Husbandry Department.

(v) The Director, Ayurved has informed the Committee that inclusion of the post of Paricharak in the service rules is under consideration at the level of the State Government. The last recruitment to the post was made about 17 to 18 years back. The First decision to be taken is whether the post is required in the future. Also, it is yet to be incorporated in the service rules and qualification and method of recruitment has to be prescribed.

(vi) When the post does not figure in service rules nor is included in the schedule appended with RCS (Revised Pay) rules 2008, nor has any method of recruitment nor have the qualifications been prescribed, it is becomes difficult for the committee to take any reasonable view on the pay scales to be granted and the nature of duties.

(vii) However, looking to the fact that the qualification of being literate suffices for the said post as informed by Director, Ayurved, the existing pay band and the grade pay assigned needs no interference.
