1. Learned counsel for the respondents submits that the suit in
question itself has been decided and hence, the present appeal
which has been preferred against the order of rejection of the
application under Order 39 Rules 1 & 2, CPC has rendered
infructuous.
2. Copy of the judgment and decree dated 20.12.2024 has
been placed on record.
3. Learned counsel for the appellant does not refute the above
fact.
4. In view of the submission made, the present appeal is
dismissed as infructuous.
