1. Learned counsel for the petitioners, inter alia, relies on the

judgment rendered in Savita Manmiya vs. State of Rajasthan

& Ors., S.B. Civil Writ Petition No. 2835/2020, decided on

16.02.2021, wherein the Single Bench of this Court opined that a

Nursing Tutor is equally entitled to compete for the post of Nursing

Officer, regardless of the nature of the post, since it also involves

certain clinical experience. However, the aforesaid view taken by

the learned Single Judge is under challenge by way of an intra-

[2025:RJ-JD:12654] (2 of 2) [CW-5323/2025]

Court appeal, wherein the observations made in the judgment

have been stayed.

2. Issue notice.

3. Mr. Mukesh Dave, learned counsel accepts notice on behalf of

the respondents. Service is thus complete. He seeks some time to

file reply.
