1. Informing that the petitioner has been denied promotion on

account of two minor penalties of censure, learned counsel for the

petitioner submitted that the issue involved in the present writ

petition is squarely covered by the judgment dated 22.08.2023,

passed by this Court in the case of Majeed Khan Vs. State of

Rajasthan & Ors. : S.B. Civil Writ Petition No.11359/2020.

2. Learned counsel for the respondents is not in a position to

dispute the aforesaid position of facts and law.

3. Having regard to the facts involved in the present case and

considering the judgment in the case of Majeed Khan (supra), the

present writ petition is also allowed.

4. The respondents are directed to consider petitioner's case for

promotion from the year 2022-2023 on the post of Assistant

Administrative Officer. In case, the law requires a review DPC to

be convened, the same be convened within a period of eight

weeks from today.

5. In case, the petitioner is found entitled for promotion against

the vacancies of the year 2022-2023, he shall be conferred

notional benefits only and actual monetary benefits shall be given

from the date of promotion.

6. The stay application stands disposed of, accordingly.
