Order

[2025:RJ-JD:6105] (4 of 4) [CW-5155/2022]

30/01/2025

1. Heard.

2. Learned counsel representing the petitioners jointly submit

that the issue involved in these writ petitions is squarely covered

by the order dated 28.07.2023 passed by the Coordinate Bench of

this Court in a bunch of writ petitions led by SBCWP

No.3053/2021 titled "Ramesh Kumar Parihar v. State of Rajasthan

& Anr.". Learned counsel further submit that the respondents

while exercising Rule 25A of the Rajasthan Service Rules, 1951

have passed the impugned order in a mechanical manner in order

to accommodate other candidates. Learned counsel further submit

that the order dated 28.07.2023 has been passed while taking

into consideration the judgment dated 13.03.2018 passed by the

Coordinate Bench of this Court in SBCWP No.6261/2017 titled

"Hemendra Kumar Trivedi v. State of Rajasthan & Ors.".

3. Learned counsel representing the respondents are not in a

position to refute the same.

4. Thus, in view of the aforesaid submissions, these writ

petitions are disposed of in terms of Hemendra Kumar Trivedi

(supra). The interim orders are made absolute.

5. Needless to observe that the respondents shall be free to

pass fresh posting order(s) qua the petitioners, if the

administrative exigency so warrants in accordance with law.

6. Stay application as well as all other pending applications, if

any, also stand disposed of.
