Order

1. Vide the present petition, a challenge has been laid to the
action whereby the services of the petitioners have been
terminated/discontinued.
2. Learned counsel for the petitioners submits that the
petitioners are being sought to be replaced by another set of
contractual employees, which is in contravention to the settled
position of law.
3. A Co-ordinate Bench judgment of this Court in Chetan
Kumar Vs. State Of Rajasthan & Ors.; S.B. Civil Writ
Petition No.17812/2024 (decided on 13.11.2024), while
dealing with a similar issue where the petitioners had been
engaged through a placement agency, observed that the
placement agency is not an instrumentality of the State.

4. The Court therein further held that there is no privity of
contract between the petitioners and the State and the services of
the petitioners were dispensed with by the placement agency
itself.
5. This Court is in total concurrence with the view expressed in
Chetan Kumar's case (supra), the facts of the present case being
akin.
6. No case for interference is made out and the writ petition is
hence, dismissed.
7. Stay petition and pending applications, if any, stand
disposed of.
