Judgment/Order

1. Heard learned counsel for the parties.
2. Since all these appeals arise out of a common judgment
dated 12.05.2025, therefore, the same are being disposed of by
this common order.
3. Learned counsel for the appellants vehemently submits that
the appellants have wrongly been denied the benefits of
[2025:RJ-JD:34157-DB] (4 of 5) [SAW-855/2025]
participation in the bid proceedings despite the appellants having
cleared the technical bid.
4. Learned counsel for the respondent-State submits that 93%
procurement in pursuance of the NIT issued by the State
Government has been done and, therefore, the procurement in
the present NIT proceedings is almost complete.
5. In view of the statement made by the learned counsel for the
respondent-State, this Court is not inclined to entertain the
present appeals on merit. However, the other legal questions
raised in the present appeals are kept open to be decided in the
appropriate proceedings.
6. At this juncture, learned counsel for the appellants submits
that in pursuance of the Appellate Authority's order dated
29.01.2025, action is proposed against the appellants. He further
submit that since the basic order of blacklisting dated 17.01.2023
is challenged before this Court by way of filing S.B. Civil Writ
Petition No.17105/2024 (M/s Multitech Automation v. State of
Rajasthan), in which, interim order is also operating in favour of
the appellants/petitioners, therefore, the proposed action in
pursuance of the appellate authority's order dated 29.01.2025
may be kept in abeyance.
7. Learned counsel for the respondent-State submits that till
the S.B. Civil Writ Petition No.17105/2024 is decided by the
learned Single Judge of this Court, the respondent-State will not
proceed with the proposed action against the appellants-
petitioners.
8. In view of the submissions made before this Court, the
present special appeals are dismissed. However, it is ordered that
[2025:RJ-JD:34157-DB] (5 of 5) [SAW-855/2025]
the respondent-State shall not proceed against the
appellants/petitioners in pursuance of the Appellate Authority's
order dated 29.01.2025 till the S.B. Civil Writ petition
No.17105/2024 assailing the validity of the blacklisting order
dated 17.01.2023 is decided by Single Bench of this Court.
9. Stay applications as well as all other pending interlocutory
applications, if any, stand disposed of accordingly.
