The instant criminal writ petition has been preferred by the
petitioner under Article 226 of the Constitution of India claiming
for the following reliefs:-
"It is, therefore most humbly and respectfully prayed that in the light of the above mentioned facts and circumstances, it is therefore most respectfully and humbly prayed that:
a) The Respondent authorities may kindly be directs to provide appropriate protection to the Petitioner.
b) Direct the concerned police authorities to ensure immediate and adequate protection to the life and liberty of the Petitioner, Ms. Aditi Mishra, and her family members, in light of the constant threats and danger posed by the private respondent.
c) Further direct the Investigating Officer to conduct a fair, impartial, and time-bound investigation in FIR No. 76/2024 registered at Police Station Sadar, District Bhilwara, Rajasthan, in accordance with law.

d) In case any FIR has been lodged against the Petitioner same may kindly be taken on record and may kindly be ordered to be quashed and set aside
e) any other appropriate order or direction which this Hon'ble Court deems just and proper in the peculiar facts and circumstances of this case may be passed in favour of the Petitioners.
f) costs of the writ petition may kindly be awarded to the Petitioner."
The petitioner has threat to his wife at the hands of private
respondent against whom she has lodged an FIR No.76/2024,
registered at Police Station Sadar Bhilwara, District Bhilwara for
the offences under Sections 376(2)(n) and 506 of IPC.
This Court, taking cue from the judgment rendered by the
Hon'ble Supreme Court in the case of "Lata Singh Vs. State of
U.P." Reported in AIR 2006 SC 2522, deems it appropriate to
dispose of the present criminal writ petition with a direction to the
petitioner to approach the Superintendent of Police, Bhilwara with
a prayer to provide her adequate protection and security.
The Superintendent of Police, Bhilwara on receipt of a
representation from the petitioner shall get the matter enquired
into and if so required, appropriate protection shall be provided to
the petitioner and her family members. The Superintendent of
Police, Bhilwara shall ensure that no harm is caused to the
petitioner and his family members.
The criminal writ petition is accordingly disposed of.
A copy of this order be sent to the respondent forthwith.
