Today in the pre-lunch session, the matter was sent to the

Registrar (Judicial) of this Court for verification of the compromise

arrived at between the parties and the same has been verified in

the presence of the parties.

After verification of the compromise, the matter is again

taken up today by this Court in the post lunch session.

The application (1/2024) for deciding the appeal on the basis

of the compromise arrived at between the parties is allowed for

reasons stated therein.

The civil first appeal is allowed and the impugned judgment

and order dated 09.10.2023, passed by learned Additional District

Judge No.1, Bikaner in Civil Suit No.638/2011 is hereby quashed

and set aside on the basis of the compromise arrived at between

the parties.

Stay application and pending applications, if any, also

decided.

Record of the trial court be sent back forthwith.

Office is directed to prepare the decree in terms of the

compromise.
