Respondent(s)

HON'BLE MR. JUSTICE UMA SHANKER VYAS Judgment / Order 11/03/2024

This second bail application has been filed by

the petitioners under Section 439 Cr.P.C. seeking

regular bail in FIR No.181/2023 registered at Police

Station Kaithwada, District Deeg for the offence(s)

under Section(s) 143, 323, 341, 307 & 325 of IPC.

First bail application earlier filed by the

accused-petitioners i.e. SB Criminal Misc. Bail

Application No.1244/2024, was dismissed as

withdrawn by this Court vide order dated 05.02.2024

[2024:RJ-JP:12011] (2 of 3) [CRLMB-2748/2024]

with liberty to file a fresh bail application after filing

of the charge-sheet.

Learned counsel for the petitioners submit that

the accused-petitioners are innocent and they have

been falsely implicated in this case. He further

submits that the charge-sheet has now been filed. He

also submits that the accused-petitioners have been

in judicial custody since long and the conclusion of

the trial will take long time, hence the petitioners

may be enlarged on bail.

Learned Public Prosecutor appearing for the

State has opposed the bail application.

Taking into consideration the overall facts and

circumstances of the case and the fact that the

charge-sheet has now been filed, but without

expressing any opinion on the merits and demerits of

the case, this Court deems it just and proper to

enlarge the petitioners on bail.

Accordingly, the second bail application filed

under Section 439 Cr.P.C. is allowed and it is ordered

that accused-petitioners namely (1) Devo S/o Vijjo

and (2) Sanjay S/o Kalu shall be released on bail,

provided each of them furnishes a personal bond in

the sum of Rs.1,00,000/- with two sureties of

Rs.50,000/- each to the satisfaction of the trial

[2024:RJ-JP:12011] (3 of 3) [CRLMB-2748/2024]

Court, with the stipulation that the petitioners shall

appear before that Court on all subsequent dates of

hearing and as and when called upon to do so.
