HON'BLE MR. JUSTICE GANESH RAM MEENA

Judgment / Order

18/01/2024

1. Counsels appearing for both the parties jointly submit that

the issue involved in the present petition is squarely covered by

the observations and directions given by the Co-ordinate Bench of

this Court in case of "Dr. (Mrs.) Neelam Singh Vs. State of

Rajasthan and Anr." (S.B. Civil Writ Petition No.

5550/2009) and other connected matters, decided on

20.12.2011.

2. In case of Dr. (Mrs.) Neelam Singh (supra) the Co-

ordinate Bench of this Court after considering the judgment

passed in similar cases, has observed as under:-

"In the aforesaid background, all these writ petitions are ordered to be governed by the judgment of this Court in the case of Smt. Sangeet Singh & Ors. (supra) in S.B. Civil Writ Petition No. 2205/2003 decided on 26.08.2004 so upheld by the Division Bench vide its judgment dated 29.11.2011. However, it is made clear that if the State Government prefers a Review Petition in the

[2024:RJ-JP:3057] (2 of 2) [CW-2441/2014]

case of State of Rajasthan Vs. Smit. Sangeet Singh & Ors. or prefers a special leave to appeal before the Hon'ble Apex Court, the final outcome thereupon would be abided by the parties and obviously be applicable to the present matters also."

3. In view of the submissions made by counsels appearing for

both the parties, the present writ petition is also disposed of in the

same terms and conditions and also with same directions given by

the Co-ordinate Bench of this Court in case of "State of

Rajasthan and Anr. Vs. Smt. Sangeet Singh and Ors." (D.B.

Civil Special Appeal (Writ) No. 768/2004 decided on

29.11.2011.

4. Since the main petition has been disposed of, all pending

application/s, if any, also stand disposed.
