1. Learned counsel for the appellant candidly admits that in the

present matter a second appeal would not lie against the order

impugned and therefore, he seeks permission to withdraw the

present appeal.

2. In view of the submission made, the permission as prayed

for is granted.

3. Accordingly, the present appeal is dismissed as withdrawn.

4. The appellant would be at liberty to take appropriate remedy

before the appropriate forum.

5. Stay petition and all pending applications, if any, also stand

dismissed.
