Learned counsel for the appellant submits that after passing

of the impugned judgment and decree dated 15.2.2017 and

during the pendency of the present appeal, one vacant shop has

been purchased by the plaintiff from the defendants and

therefore, no cause now survives in the present appeal. He

submits that the appeal, therefore, has rendered infructuous.

In view of the submission made, the present appeal is

dismissed as infructuous. The stay application as well as all

pending applications, if any, also stand dismissed.
