1. At the outset, learned counsel for the petitioner seeks

withdrawal of the instant criminal revision petition with liberty to

make a prayer through filing a leave to appeal under Section 378

(4) of the Cr.P.C. against the judgment of acquittal/dismissal of

complaint dated 02.09.2019.

2. The prayer seems to be genuine, accordingly, the instant

criminal revision petition is dismissed as withdrawn with liberty to

the petitioner to make a challenge to the order dated 02.09.2019

[2023:RJ-JD:27969] (2 of 2) [CRLR-1381/2022]

by way of filing of a criminal leave to Appeal under Section 378

(4) of the Cr.P.C. before this Court within next 60 days along with

an application under Section 5 of the Limitation Act.

3. The delay as would be occurred in filing shall be considered

as bona-fide because of approaching a wrong forum due to

inadvertence.
