This is an appeal filed by the appellants seeking leave to

appeal as the appellants were not a party in the writ petition.

Even if, we are inclined to grant leave to appeal, we find that

the appeal against the interim order is completely misconceived in

law. What the learned Single Judge has done is to provide an

interim/provisional arrangement to protect the interest of the writ

petitioners. Their provisional participation in the process of

selection will not affect the merits of the case.

Submission of learned counsel for the appellants that learned

Single Judge has granted final relief cannot be accepted. Making

provisional arrangement for participation of the candidates cannot

be said to be a final relief. There is no direction for appointment of

such person.

The other submission of learned counsel for the appellants is

that those who approached the writ court cannot claim similarity

of work, need not to be answered by us because that issue is still

pending consideration.

The appeal viewed from any angle is misconceived and is,

therefore, dismissed.

Application No. 01/2023 for grant of leave to appeal is also

dismissed.
