1. Mr. Bharat Singh Rathore, learned counsel for the pettioner
submits that the controversy involved in the present writ petition
is squarely covered by the judgment of this Court dated
03.09.2021 rendered in the case of Subhash Chandra vs. State of
Rajasthan & Ors. : S.B. Civil Writ Petition No. 10353/2021.
2. Mr. Vyas, learned Additional Advocate General is not in a
position to dispute the aforesaid position.
3. Hence, following the judgment aforesaid, the present writ
petition is also allowed.

4. The impugned order dated 26.04.2021, qua the petitioner is
hereby quashed.
5. Stay application also stands disposed of, accordingly.
