1. Mr. Jodha, learned counsel appearing on behalf of the State

at the outset submitted that the controversy involved in the

present matter has been decided against the petitioner by way of

a judgment dated 23.01.2023, passed in the case of Shankar Lal

& Ors. Vs. The State of Rajasthan & Ors.; S.B. Civil Writ

Petition No.12784/2020.

2. Learned counsel for the petitioner is not in a position to

dispute the aforesaid position of facts and law.

3. The present writ petition is, therefore, dismissed in terms of

the judgment rendered in the case of Shankar Lal (supra).

4. Stay application stands disposed of.
