Taking into consideration that writ petition has already been

filed by the appellant herein and simultaneously against another

order of the Customs, Excise & Service Tax Appellate Tribunal

(CESTAT) this appeal has been filed, we are inclined to dismiss

this appeal with liberty to revive depending upon the result/

outcome of the petition.

Accordingly, this appeal is dismissed.
