1. The Special Secretary, Home, who passed the

order/resolution dated 28.09.2015, whereby the prosecution

against the accused respondent was directed to be withdrawn; to

furnish an affidavit to convince this court as to what public interest

was involved, which persuaded him for making a resolution for

withdrawal of the criminal case against the accused, which

pertains for forming unlawful assembly, setting ablaze houses,

offence of house-breaking and theft. It shall also be convinced

that whether the resolution for withdrawal of prosecution is in

consonance with the spirit and soul of the judgment rendered by

Hon'ble Supreme Court in the cases of The State of Kerala vs. K

Ajith & Ors. reported in AIR 2021 SC 3954 and Sheo Nandan

Paswan Vs. State of Bihar reported in AIR 1987 SC 877. The

needful shall be done before the next date of hearing.
