Heard learned counsel for the petitioner.

Learned counsel for the petitioner submits that the petitioner

is serving at Sri Ganganagar since 2022. He is being transferred to

District Bharatpur vide order dated 28.04.2023. He further

submits that the petitioner will superannuate on 31.08.2024 and

less than two years have left. Learned counsel for the petitioner

relying upon a judgment of Division Bench of this Court in the

case of Pushpa Mehta Vs. Rajasthan Civil Services Appellate

(2 of 2) [CW-6266/2023]

Tribunal and Ors., reported in RLW 2000 (1) Raj 233,

submits that the petitioner may be allowed to work at present

place of posting i.e. Sri Ganganagar.

Matter requires consideration.

Issue notice, returnable on 05.07.2023. Issue notice of the

stay application also.

Meanwhile and till the next date of hearing, effect and

operation of the transfer order dated 28.04.2023, qua the

petitioner shall remain stayed.
