For the reasons stated in the application (1/2023), the same

is allowed. The compliance report cum additional affidavit is taken

on record.

Inviting attention of this Court towards the order dated

01.07.2022 and the statement of account and other documents

(2 of 2) [CCP-2350/2018]

appended with the compliance report, learned counsel for the

respondents submits that in compliance of the direction of this

Court dated 06.12.2017, the petitioner has been given all

consequential benefits treating him senior to the person junior to

him as per his placement in the merit list. She, therefore, prays

for dismissal of the contempt petition.

None for the petitioner even in second round.

Heard. Considered.

This Court has, vide order dated 06.12.2017, disposed of the

writ petition filed by the petitioner in the light of judgment of this

Court in case of Suman Bai & Anr. Vs. State of Rajasthan & Ors.:

2009 (1) WLC (Raj.) 381 whereby, the writ petition was allowed

and the respondents were directed to treat the petitioners senior

to respondents No. 4 to 8 as per their placement in the merit list.

A perusal of the order dated 01.07.2022 and other

documents appended with the compliance report filed by the

respondents reveals that the petitioner has been given seniority as

per his placement in the merit list as also consequential benefits.

Since, there has been substantial compliance of the order

dated 06.12.2017 passed by this Court, contempt whereof is

alleged, this contempt petition is dismissed.

Notices are discharged.
