Learned counsel for the petitioner submits that the execution
proceedings is underway and coercive steps are being taken for
the recovery of the amount. The petitioner was not under
employment for a long period and now he got a job in a private
company and he is ready and willing to pay the amount. She
urged that despite the good intention of the petitioner in
depositing the amount in pieces, learned trial court had struck off
the defence and vide order dated 25.08.2022, his right to cross-
examine the applicant/respondent was closed and the impugned
judgment dated 16.09.2022 has been passed without affording
him the proper opportunity.
Heard and perused the material available on record.
In the peculiar facts and circumstances of the case, it is
deemed appropriate to direct the petitioner to pay a sum of Rs.
50,000/- in two installments, the first installment shall be paid on
01.04.2023 and the next 25,000/- shall be deposited with the trial
court on 01.05.2023.

In the event of deposition of the amount, the same shall be
disbursed to the applicant/respondent.
Issue fresh notice to the respondents, returnable on
25.04.2023.
Till next date except the aforesaid Rs.50,000/- rest of the
amount shall not be recovered from the petitioner.
