1. Petitioner has filed this bail application under Section 439

Cr.P.C.

2. F.I.R. No.154/2022 was registered at Police Station

Pachewar, District Tonk for offence under Sections 143, 341, 323,

308 I.P.C.

3. It is contended by counsel for the petitioner that the

petitioner has been falsely implicated in this case. Counsel submits

that both the parties have entered into compromise. He is behind

the bars since 15.11.2022 and further detention of the petitioner

is not required for any purpose. Trial of the case is likely to take

considerable time.

4. Counsel appearing for the complainant has admitted the

factum of compromise and submits that the complainant does not

want to take any action against the accused-petitioner.

5. Learned Public Prosecutor has opposed the bail application.

6. I have considered the contentions.

7. Considering the contentions put forth by counsel for the

petitioner and taking note of the fact that compromise has taken

place between the parties but without commenting any opinion on

the merits and demerits of the case, I deem it proper to allow the

bail application.

8. This bail application is, accordingly, allowed and it is directed

that accused-petitioner shall be released on bail provided he

furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees

One Lac only) together with two sureties in the sum of

Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction

of the trial Court with the stipulation that he shall appear before

that Court and any Court to which the matter be transferred, on

all subsequent dates of hearing and as and when called upon to do

so.
