03/01/2023
1. Mr. Mahaveer Bishnoi, learned counsel for the petitioner
pointed out that the petitioner's name was shown in the select list
on 25.10.2016, however, her name was shown as 'Dhamu Bai' in
place of 'Ghamu Bai'. Hence, the petitioner was not allowed to
join and the respondents themselves took four years in correcting
their own error, due to which, the petitioner, who should have
been allowed to join in October, 2016 was given joining as late as
on 24.01.2020.
2. Learned counsel further argued that the petitioner is entitled
for notional benefits including grant of experience certificate from
the date of appointment order (25.10.2016). In support of his
contention, learned counsel for the petitioner relied upon
judgment passed by a co-ordinate Bench of this Court dated
03.01.2020 in S.B. Civil Writ Petition No. 10729/2018 : Naveen
Patidar v. The State of Rajasthan & Ors.
(2 of 2) [CW-19336/2022]
3. Mr. Shreyansh Mehta, learned counsel for the respondents
prays for and is granted two weeks' time to file reply.
4. Meanwhile, the respondents are directed to issue experience
certificate to the petitioner within a period of three days in
accordance with law, showing her experience w.e.f. 01.11.2016.
5. The requisite certificate be issued latest by 12:00 noon of
06.01.2023.
