Heard counsel for the petitioner.

Learned Senior Counsel submitted that the issue involved in

this writ petition has been considered by the Hon'ble Supreme

Court in the matter of Levaku Pedda Reddamma V/s.

Gottummukkala Venkata Subbamma, Aironline 2022 SC 244.

In that view of the matter, issue notice to the respondents,

returnable on 3.2.2023.

Meanwhile, the commercial Court, Kota is directed not to

pass final judgment in Civil Suit No.59/18.
