By way of instant writ petition, petitioner has challenged the
penalty order dated 13.12.2022.
It has been stated that for same set of facts and charges,
petitioner is facing criminal trial under Section 409 IPC and in the
meantime the departmental inquiry has been finalized and penalty
order has been passed. Findings of the departmental inquiry may
adversely affect the trial/defence of petitioner in the criminal case.
Reliance has been placed on the judgment in case of Stenzen
Toyotestsu India Private Ltd. Vs. Girish V. [(2014) 3 SCC
636].
Heard.
Admit.
Issue notice to respondents.
In the meanwhile, it is observed that findings in the
departmental inquiry and the penalty order shall not adversely
affect the defence of petitioner in the criminal trial.
