1. Mr. Ripudaman Singh, learned counsel for the petitioner
submits that the order impugned dated 28.09.2022 is contrary to
Rule 8(iii) of the Rajasthan Panchayati Raj (Transferred Activities)
Rules, 2011 and a number of judgments passed by this Court in
this regard.
2. Issue notice. Issue notice of stay application also.
3. Mr. Shreyansh Mehta, learned counsel accepts notice on
behalf of the respondent State and prays for and is granted four
weeks time to file reply.

4. Meanwhile, effect and operation of the order dated
28.09.2022 (Annex.-2) shall remain stayed.
