Though time was granted to learned counsel for the

respondents on 08.12.2022 to address this Court as why case of

the petitioner was not liable to be considered in view of the

judgment already passed by Coordinate Bench of this Court in the

case of Phoola Ram Fageria Vs. State of Rajasthan & Anr.

(S.B. Civil Writ Petition No.305/2005).

However, learned counsel-Mr. Prakhar Gupta, appearing for

the respondents submits that a letter has been received by him

yesterday only and as such, he needs one more opportunity to

place complete facts on record as well as to address this Court

about applicability of two other judgments which have been

passed on similar issue.

Learned counsel may do the needful.

List on 17.01.2023 at the orders stage.
