1. By way of present petition, the petitioner has challenged the

order dated 01.12.2022, whereby the respondent No. 4 has been

appointed as Anganwari Worker.

2. The petitioner has got an alternative and efficacious remedy

under the scheme relating to 'Aaganwari Worker' best suited for

the facts involved in this case.

3. That apart, in light of judgment of this Court rendered in the

case of Bidami Devi Vs. State of Rajasthan & Ors. [DB Civil

(2 of 2) [CW-19633/2022]

Special Appeal (Writ) No.663/2016], the petitioner is required

to avail statutory remedy of appeal.

4. In view of the aforesaid, without entering into the merit of

the case, the writ petition is disposed of with a direction to the

petitioner to file an appeal before the Appellate Authority within a

period of 30 days.

5. In case the appeal is so filed, the Appellate Authority shall

decide the same in accordance with law as early as possible,

preferably within a period of six months from receipt thereof.

6. Stay application too stands disposed of accordingly.
