Learned counsel for the appellants submits that issue raised

in the present appeal is squarely covered by judgment in Union of

India & Ors. v. Mahaveer & Ors.: D.B. Special Appeal Writ

[2023/RJJD/002808] (2 of 2) [SAW-137/2020]

No.936/2022, decided on 9.12.2022, whereby, the appeals arising

from the similar order have been dismissed by Division Bench.

In view of the submissions made, following the judgment in

Union of India & Ors. v. Mahaveer & Ors. (supra), the present

special appeal is also dismissed.
