Learned counsel for the petitioner submits that the
controversy involved in the present writ petition relating to right of
married daughter to be appointed on compassionate ground has
been decided by the Full Bench of this Court in Civil Reference
No.1/2022 (Priyanka Shrimali Vs. State of Rajasthan &
Ors.) decided on 13th September, 2022.
Learned counsel further submits that definition of dependent
has also been amended in the Rajasthan Compassionate
Appointment of Dependents of Deceased Government
Servants Rules, 1996.
Learned counsel for the petitioner wants to bring the relevant
amendment and case-law in support of his arguments.
Learned counsel for the respondents submits that the Apex
Court in the case of State of Maharashtra & Anr. Vs.
Ms.Madhuri Maruti Vidhate (2022 LiveLaw (SC) 820) has
decided the similar controversy, whereby the married daughter
(2 of 2) [CW-241/2021]
has not been considered as a dependent of the deceased
government servant.
Learned counsel for the petitioner wants to go through the
said judgment.
