Judgment / Order

24/02/2023 The writ petition was filed in the year 2019.

When the matter was listed on 09.09.2019 before

the Registrar (Admn.), no-one put in appearance on that day

on behalf of the petitioners and the last opportunity of two

weeks was granted to the petitioners for removing the

defects. On 2.3.2021 the case was listed before the Court and

even on the aforesaid date, no-one put in appearance on

behalf of the petitioners. However, this Court allowed two

weeks time to the petitioners to remove the defects and

further observed that in case the defects are not removed,

the writ petition shall stand dismissed without reference to

the Court and in view of the pre-emptory order dated

2.3.2021, the writ petition stood dismissed on 31.03.2021.

On filing S.B. Writ Restoration Application

No.167/2021, this Court vide order dated 27.10.2021 while

allowing the restoration application, restored the writ petition

to its original number.

The petitioners again failed to cure the defects as

pointed out by the Registry even after passing of about four

years.

Considering the aforesaid facts, it reveals that the

petitioners do not want to prosecute the writ petition. Hence,

the writ petition is dismissed for non-prosecution.
