The present revision petitions have been preferred against

the order dated 22.12.2021 whereby the applications under Order

7 Rule 11 as preferred by the defendant have been rejected.

Admittedly, the defendants were licensees and the suit has

been preferred by the plaintiff for mandatory injunction with a

consequential relief of possession.

Learned counsel for the respondents relied upon the Hon'ble

Apex Court judgment passed in the case of Bharat Bhushan

Gupta Vs. Pratap Narain Verma & Anr.; AIR 2022 SC 2867,

decided on 16.06.2022 covering almost all the issues raised in the

present petition.

Learned counsel for the petitioner prayed for last opportunity

to argue out on the said submission.

Let the matters be listed on 13.02.2023.

Interim order, if any, to continue till the next date.
