Order
09/02/2023 Heard learned counsel for the petitioners.
Learned counsel for the petitioners submits that the
controversy involved in the present case is squarely covered by a
judgment of this Court rendered in S.B. Civil Writ Petition
No.10736/2022 "Jannu Khan Vs. State of Rajasthan &
Ors." and other connected matters decided on 25.08.2022. He
further submits that this Court in S.B. Civil Writ Petition
No.17416/2022 "Pratap Das Vs. State of Rajasthan & Ors."
has also passed the similar order on 18.11.2022.

In view of the submissions made before this Court, the
present writ petition is disposed of with a direction to the
respondent No.4-Tehsildar, Bhim, District Rajsamand to decide the
pending notice dated 14.01.2022 and the reply to the same filed
by the petitioners in accordance with law. The respondent No.4
shall decide the same within a period of eight weeks from today
and till the respondent No.4 decides the matter under Notice
dated 14.01.2022, the petitioners shall not be dispossessed from
the subject piece of land.
Stay petition also stands disposed of.
The present writ petition is disposed of on the submission
made by the learned counsel for the petitioners and if the
authorities find that the matter is not squarely covered by the
judgments rendered in the case of Jannu Khan and Pratap Das
(supra), they will be free to take appropriate action in accordance
with law.
