Learned counsel for the appellant submits that in pursuance
to the judgment and decrees passed by the learned Courts below,
the possession of the premises in question has been handed over
to the respondent-plaintiff. He therefore, seeks permission to
withdraw the present second appeal.
The permission as prayed for is granted.
The present second appeal is therefore, dismissed as
withdrawn. The Court fees as filed by the appellant be refunded to
him in terms of law.
The stay petition and all pending applications also stand
dismissed.
