Heard Mr. R.D. Rastogi, learned Additional Solicitor General

of India for the appellant and Mr. Amit Mathur, learned counsel

appearing for the respondent.

The argument is that a similar judgment and order of the

Tribunal, as impugned in this writ petition, has already been set

aside by this Court vide judgment and order dated 10.05.2018

passed in a batch of writ petitions in which leading was D.B. Civil

Writ Petition No.18488/2016- The Union of India & Ors. Vs. Dev

Karan Mahala & Ors.

Issue notice to the respondent by registered post, returnable

within six weeks.

List for admission/final disposal immediately thereafter along

D.B. Civil Writ Petition No.18585/2022.

Until further order of this Court, the effect and operation of

the impugned judgment and order dated 05.05.2022 shall remain

stayed.
