1. By way of the present writ petition, the petitioner has prayed
that her candidature be considered as an OBC non-creamy layer
candidate.
2. The certificate, which was produced by the petitioner has
been issued by the authority of State of Madhya Pradesh.
3. In light of the judgment of this Court rendered in the case of
Sushila Kumari Vs. State of Rajasthan & Ors. : S.B. Civil Writ
Petition No.824/2020 decided on 20.02.2020, the petitioner who
has migrated to Rajasthan, cannot be treated to be an OBC of the
State of Rajasthan.

4. Mr. K.S. Rajpurohit, learned Additional Advocate General,
regardless of the above, submitted that the petitioner has been
given appointment on her own merit in the General category.
