1. A perusal of the record is revealing that for accusation of
committing an offence under Section 498-A of the IPC, the
accused respondent was charge-sheeted and after rigorous
trial he was convicted for the charge.
2. Aggrieved by the judgment of conviction, the accused
respondents preferred an appeal in which after hearing the
parties, the learned appellate Court acquitted the accused
respondents. Hence, the instant leave to appeal is preferred.
3. Heard.
4. After going through the niceties of the matter and taking into
account that in the Court of first instance, the offence was
found proved. This Court deems it appropriate to allow the
petitioner to prefer an appeal against the judgment of
[2023/RJJD/012148] (2 of 2) [CRLLA-338/2018]
acquittal passed by the appellate Court. Accordingly, the
instant application seeking leave to appeal is allowed. The
memo of leave to appeal application shall be treated and
registered as an appeal.
