At the outset, learned counsel for the petitioner seeks

withdrawal of the instant revision petition.

The prayer sought for is allowed.

Accordingly, the instant revision petition is disposed of as

withdrawn. However, looking to the facts and circumstances of the

[2023/RJJD/010824] (2 of 2) [CRLR-722/2022]

case, the petitioners would be at liberty to raise all their

objections/grounds which are raised herein this petition before the

trial court at the appropriate stage. At the culmination of the trial,

learned trial court shall take into consideration the fact that

whether the death was the direct result of the act of the accused

or it was developed subsequent to the incident and then the

judgment shall be passed in accordance with the legal provisions.

Stay petition also stands disposed of.
