Shri Jagdish Vyas raised a preliminary objection regarding
maintainability of the instant writ petition submitting that a similar
provision prevailing in the pension scheme of LIC (as is challenged
in relief of clause No.1 of the instant writ petition) was upheld by
the Hon'ble Delhi High Court vide judgment dated 27.04.2017
(Federation of Retired LIC Class I Officer Vs. UOI & Ors. - W.P. (C)
No. 184/2007).
Faced with this situation, Shri Bhandari candidly concedes
that the challenge to the validity of the Clauses 35 (C) and 3A in
Appendix IV of the General Insurance (Employees) Pension
Scheme, 1995 does not survive. Thus, to this extent the prayer
made by the petitioner is liable to be and is hereby rejected. The
remaining prayers are to fit to be examined by the learned Single
Bench.

Thus, this writ petition shall be listed before the concerned
Single Bench for consideration and decision.
