1. Appellant-JVVNL has filed this first appeal assailing judgment

and decree dated 8.4.2022 in suit No.153/2019 by District Judge,

Jaipur whereby a compensation of Rs.15,46,360/- has been

decreed in favour of respondents-plaintiffs.

2. There is a delay in filing the appeal, separate application

under Section 5 of the Limitation Act has been filed.

3. For reasons mentioned in the application, the same is

allowed. Delay in filing the appeal is condoned.

4. Heard.

5. Admit.

6. Issue notice to respondents.

7. Record of the trial Court be summoned.

8. It has been informed that respondents have proceeded for

execution of the impugned decree. In case appellant deposits

entire amount of compensation along with interest within a period

of four weeks before the trial Court, execution of impugned decree

shall remain stayed. In case appellants fails to deposit the amount

within the aforesaid period, respondents-plaintiffs may proceed for

execution.

9. If, the compensation amount so deposited, 50% amount be

disbursed to respondents-plaintiffs through saving bank account

furnished by them. Remaining 50% compensation amount shall

remain deposited in separate FDR, in a nationalized bank initially

for a period of three years subject to renewal from time to time.

10. The trial Court may complete the exercise of deposition and

disbursement of compensation, as mentioned above, thereafter

shall send the record this Court.
