Counsel for the petitioner submitted that the issue involved

in this writ petition has already been considered by a Co-ordinate

Bench of this Court at Principal Seat, Jodhpur in the matter of Dr.

Narendra Kumar Tak Vs. State of Rajasthan & Ors. (S.B. Civil Writ

Petition No.1040/2018), where in on 23.01.2018, the following

order was passed:-

"Learned counsel for the petitioner relies on judgment of this Court in Shailendra Kumar Bhatt V. State of Raj. & Ors.:SBCW No.2250/2013, decided on 20.05.2013.

Issue notice. Issue notice of the stay application also, returnable in four weeks.

Notices when issued be given 'dasti' to the learned counsel for the petitioner.

In the meanwhile and till further orders, the operation of punishment order dated 09.05.2017 and the appellate order dated 22.12.2017, shall remain stayed."

In that view of the matter, issue notice to the respondents,

returnable by six weeks.

No.11497/2022 after six weeks.

Meanwhile, operation of the order dated 13.08.2020 &
