Learned counsel for appellants has placed reliance on a

Circular dated 07.05.1998, issued by the Rajasthan State Road

and Transport Corporation (RSRTC), wherein it is provided that

selection grades shall be provided to those employees, whose

record is satisfactory. The first appellate court has granted

selection grades to respondent-plaintiff without examining the

record of the delinquent employee as satisfactory.

Heard.

Issue notice to respondent.

No case is made out to stay the execution of the impugned

judgment and decree dated 27.09.2017 in ex parte after expiry of

five years.
