1. Realising that in light of the judgment of this Court rendered

in case of G.K. Construction Company vs Balaji Makan Samagri

Stores (S.B. Criminal Misc(Pet.) No. 189/2022), the petitioner has

no sustainable arguments, Mr. Nayak, learned counsel for the

petitioner makes an alternative prayer that the petitioner be

allowed a month's time to comply with the impugned order dated

20.08.2022.

2. Having heard learned counsel for the petitioner and

considering that a substantial amount is required to be deposited

by the petitioner in compliance of provisions of Section 148 of the

Negotiable Instruments Act, the petitioner is allowed to deposit

the requisite amount by 15.11.2022.

                                   3.    In    case,    the    requisite       amount         is       not    deposited    by

                                   15.11.2022,         petitioner's       appeal        (being          Criminal      Appeal

No.39/2022) shall stand dismissed.

4. The present petition so also the stay application stands

dismissed accordingly.
