Learned counsel for the appellant submits that the learned

EC Commissioner, Udaipur without applying the legal provisions of

ECC Act, 1923, has wrongly imposed the penalty of Rs.1,31,970/-

upon the appellant-owner. In support of his contentions, learned

counsel for the appellant relied upon the judgment of Hon'ble

(2 of 2) [CMA-1958/2022]

Supreme Court delivered in the case of Oriental Insurance

Company Ltd Vs. Sibey George & Others reported in 2012 0

Supreme (SC) 507.

Matter requires consideration.

Heard.

Admit.

Issue notice to the respondents. Issue notice of the stay

application also, returnable within a period of six weeks.

Call for the record.

Meanwhile, the effect and operation of the order dated

18.7.2022 passed by the EC Commissioner, Udaipur in Case

No.12/2006 inflicting penalty to the tune of Rs.1,31,970/- qua the

appellant shall remain stayed.
