After attempting to argue the matter on merits for

quite some time, learned counsel for the petitioner has

submitted that the petitioner would be satisfied if a

direction is issued to the respondent Nos.2 and 4 to

consider his representation (Annex.9) before acting upon

the recommendations of the Mining Engineer, Mines and

Geology Department, Nagaur dated 8.3.2022 (Annex.8).

In view of the limited prayer made by learned

counsel for the petitioner, this writ petition is disposed of

(2 of 2) [CW-7599/2022]

with the expectation that before acting upon the

recommendations dated 08.3.2022 (Annex.8), the

Superintendent Engineer, Mines and Geology

Department, Ajmer Circle, Ajmer shall consider the

representation of the petitioner (Annex.9) if the same is

not yet considered.
