The matter comes upon an application for substituting the

name of respondent No. 2 from the Director, Secondary Education,

Government of Rajasthan, Bikaner to Director, Elementary

Education, Government of Rajasthan, Bikaner.

For the reasons stated in the application, the same is

allowed.

The Director, Elementary Education, Government of

Rajasthan, Bikaner is permitted to be substituted in place of the

present respondent No. 2. Amended cause title as filed be taken

on record.

Mr. K.K. Bissa, AGC put in appearance on behalf of the

respondents.

Counsel for the petitioner is directed to serve a copy of the

petition on Mr. K.K. Bissa. Mr. Bissa is directed to complete his

instructions thereafter.

The other application has been moved on behalf of the

petitioner with the submission that the present matter be decided

(2 of 2) [CW-11121/2012]

in light of judgment passed by the Division Bench of this Court in

D.B. Civil Writ Petition No. 3964/2011; Sushil Sompura Vs.

State of Raj. & Ors (decided on 20.05.2011) as well as the

judgment passed by this Court in S.B. Civil Writ Petition

No.12982/2018; Puran Mal Vs. State of Raj. & Ors (decided

on 19.09.2018).

Counsel for the respondents prays for time to complete his

instructions pertaining to the above submissions.

Time prayed for is granted.

List the matter on 11.07.2022 after showing the name of Mr.

K.K. Bissa, AGC in the cause list as counsel for the respondents.
