Issue notice.
Learned Public Prosecutor accepts notice on behalf of the
respondent-State.
Let notice should go to respondent No.2 through both the
processes, returnable by 28.06.2022.
Requisites be filed within 10 days.
By the impugned order, the learned Court below has taken
cognizance against the petitioner for the offences under Sections
376, 376D and 120B of IPC, after disagreeing with the Police
report.
Prayer for stay has been made on the ground that
complainant is in habit of lodging false cases and certain other
cases lodged by her to extract money has been found untrue.
Considering the facts of the case as well as the judgment of
the Hon'ble Supreme Court in the case of M/s Neeharika
Infrastructure Private Limited Vs. State of Maharashtra and others
(2 of 2) [CRLMP-3892/2022]
decided on 13.04.2021 in Criminal Appeal No.330/2021, it is not a
fit case for interim relief as such prayer is refused.
The stay application is rejected.
